Attorney Melody Manning is celebrating five years on #TeamRebein and this is what she has to say about her experiences!

 

As I approach my 10 year law school class reunion, I have now practiced for 5 years doing big firm defense and, most recently, 5 years fighting against insurance companies on behalf of people who are injured due to someone else’s negligence. Only this past year have I really realized how skeptical and distrusting people are of people who bring claims for injury (and their attorneys). It’s like the old adage – everyone hates lawyers until they need one. So, at this 5 year mark, I want to share what I do and how I feel about it!

Every case starts with someone coming into our office worried, injured, and confused because they were either hurt in a car accident or some other way, and they don’t know what to do to even start to feel better or get their life back to normal. No matter how old, or young, or healthy, or unhealthy this person is – I already know the insurance company is going to say they weren’t really hurt, or they weren’t hurt that badly, or any symptoms they are feeling are age related, and their treatment was unnecessary, and their bills are unreasonable, and the accident wasn’t that bad, etc.

The human body is not a machine. It’s very easy to hurt your neck and your back when you have a 3,000 pound vehicle hit your vehicle – no matter how fast or slow it is going. Most people just want their car fixed and they want to feel better and move on with life. But, again, the human body doesn’t always heal back perfectly and people are often left with continuing symptoms that an insurance company will never accept or believe, or compensate for.

And then my client has 3 choices – accept a settlement that may not be fair, accept a settlement based on limited insurance available (very common), or file a lawsuit and proceed towards trial where they will ultimately have 6 very skeptical people judging every little thing they say or do – and often without any way to objectively prove they are still feeling pain.

So, in conclusion:
1) Make sure you are adequately insured! There are too many uninsured people driving recklessly where we live;
2) If you ever get called for jury duty, have an open mind and listen without preconceived notions as the plaintiff tells their story; and
3) I wouldn’t change what I do for the world! As hard and as stressful as it is fighting “the man,” I live to work my hardest for my clients and want nothing more than for them to be satisfied they knew their options and satisfied in quick and educated resolutions of their cases.
