I’ve been seeing an increasing number of cases in Florida where the client was in a car accident while in an UBER or LYFT vehicle. There are several issues when an UBER or LYFT auto accident occurs.
Does UBER or LYFT carry liability insurance to cover these drivers if they are at fault? The answer is yes. Both UBER and LYFT have commercial liability policies that cover their drivers while working.
Let’s assume the accident was not the fault of the UBER or LYFT driver. Can the passenger and/or the UBER or LYFT driver recover? Again, the answer is yes. The passenger and the driver can recover from the at fault driver’s insurance.
What if the at fault driver doesn’t have any bodily injury coverage or doesn’t have enough coverage? In these cases, you can recover under UBER/LYFT’s uninsured or underinsured motorist coverage. In my experience, these policies provide substantial uninsured/underinsured motorist coverage.
